8:15 a.m. - 9:45 a.m. Handling the Discipline, Grievance and Arbitration Process, including a panel discussion of hypothetical arbitration cases by experienced arbitrators; strategies for dealing with employees failing to meet expectations; methods of conducting workplace investigations, imposing discipline, and discharging employees; and interpreting the collective bargaining agreement.

Ÿ10:00 a.m. - 11:30 a.m. Recent Developments with the NLRB, including a review of major new procedures and cases affecting union and non-union employers, including the Browing-Ferris joint employer decision, employee use of an employer’s e-mail system; employee use of social media in relation to the employer; and other National Labor Relations Board (NLRB) updates and trends.

11:30 a.m. - 12:45 p.m. Labor Law Luncheon

12:45 p.m. - 1:45 p.m. Hot Topics in Employment Law, summarizing new employment laws, cases, and proposed legislation, including recent developments in healthcare reform, wage claims, employee leave laws, and updated requirements for government contractors.

1:45 p.m. - 2:00 p.m. Break

2:00 p.m. - 3:00 p.m. ŸRegulatory Roundup: An Update on Agency Developments for Employers, covering the ever-changing regulatory landscape, including new or amended regulations, rules, and initiatives from the Department of Labor (DOL), the U.S. Equal Employment Opportunity Commission (EEOC), the Minnesota Department of Human Rights (MDHR), the Office of Federal Contract Compliance Programs (OFCCP), the Occupational Safety and Health Administration (OSHA), and other related agencies.

3:00 p.m. - 3:30 p.m. NLRB’s New Persuader Rule, covering the DOL’s most recent changes to the new Persuader Rule and how it affects employer’s and their counsel, as well as recent actions taken against the DOL’s new Persuader Rule implementation.

3:30 p.m. - 4:30 p.m. Collective Bargaining Trends and Strategies, covering wage patterns, pension and insurance issues including withdrawal liability, subcontracting, concessionary bargaining strategies, and contingency plans for potential bargaining impasses and strikes.
